Accident Claim Do’s and Don’ts

There are a number of different types of accident claims that can be made by an individual.  Work accident claims, a car accident claim a personal injury claim – literally the list goes on and on.  No matter what the claim type is you will eventually need to deal with your insurance company, and the process of making a claim can be overwhelming.  You will have to deal with insurance adjusters, claims representatives, the whole 9.  In order to prepare you for this we have created a do’s and don’ts list regarding insurance claims to get you ready for the eventuality of having to speak with an accident claim lawyer or even worse, accident claim lawyerS – plural.

Accident Claim Do’s:

Get in touch with your individual insurance agency if you were involved in any type of accident as soon as you possibly can.  Obviously if you need medical attention get that first but the more time that goes by without legal representation from somewhere the worse off you will be.

Review your insurance policy in terms of what it does and does not cover regarding your specific accident.  Be ready getting compensation for personal injury can be harder than you think.

Do the very best you can to get a thorough rendition of the accident, whether its through photos, videos or witnesses make sure you get some type of verification. Don’t forget to get names, phone numbers and insurance information from the parties at fault, even if it was just a slip and fall settlements.

As you go through the claims process make sure you take note of conversations you have with insurance adjusters, this includes their names, the time of the conversation and their employee identification numbers.

Save all the pertinent information regarding out of pocket expenses regarding your accident, medical bills, mileage to a doctor, phone and time on calls with adjusters, repairs to personal property, this can help you get more for your pain and suffering settlement.

Be as honest and forthcoming as you can with officers and adjusters, you do not want your case eventually thrown out.

Make sure you are aware of any and ALL of the insurance providers you have because you may have overlap in coverage, you may be able to send some bills to the Health Insurance company and others to the Car Insurance Company helping you get more car accident compensation.

Accident Claims Don’ts:

Do NOT admit to any kind of at fault actions.  That is not for you to decide as there may be more information to come forth from others, you may think you didn’t have the right of way, but did and the other party was sending a text.

NEVER ever EVER sign your name to anything before you consult an accident claim lawyer.  There are so many ways the insurance company can screw you it would make your head spin, so get someone on your side first.

Do NOT let any type of time constraints prevent you from making a claim.  Make the claim early because each insurance company will have different due dates, know yours and submit your claim promptly.

Your accident claims settlement is not to be evaluated at the face value the insurance company gives you.  What they think is fair may not be in your best interest.

Never sign any waivers. PERIOD.

Do not be tempted to take a check unless you are absolutely certain the claims value is fair, most times fairness is judged by the size of the structure settlement.

There is a reason all those attorneys who follow the ambulances make so much money, its because they know EXACTLY what they are doing.  There is no shame in getting them to fight for you in an accident claim situation.
